BesidesGuide LLC (“Besides,” “we”) respects the intellectual property rights of others and expects users and content sources to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement on besidesguide.com that are reported to our designated copyright agent identified below.

Filing a takedown notice

Under 17 U.S.C. § 512(c)(3), a valid takedown notice must include substantially all of the following. Notices missing any element may be treated as insufficient and may not be acted upon.

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to permit us to locate the material — ideally a direct URL on besidesguide.com.
  4. Information reasonably sufficient to permit us to contact the complaining party, including an address, telephone number, and, if available, an email address.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Misrepresentation

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages including costs and attorney’s fees.

Counter-notice

If you believe content of yours was removed or disabled by mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3) to the same address. A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Besides may be found, and that you will accept service of process from the person who provided the original takedown notice or an agent of that person.

Upon receipt of a valid counter-notice we will forward a copy to the original complainant and may restore the removed material in 10 to 14 business days unless the complainant first notifies us that they have filed an action seeking a court order to restrain the conduct.

Repeat infringers

It is BesidesGuide LLC’s policy to terminate, in appropriate circumstances, the access of users and content sources who are repeat infringers.

Source attribution and excerpts

Pages on Besides may quote short excerpts from publicly available reviews and discussions under the fair-use doctrine, with attribution and a link back to the original source. If you are the author or rights holder of a quoted excerpt and would like it removed, you can either follow the formal DMCA process above or send a less formal removal request to takedown@besidesguide.com identifying the page and the excerpt. We will act on good-faith removal requests even when they are not formal DMCA notices.
